Legislative Decree 151/2005 RAEE

What is the RAEE Decree?

The Legislative Decree 151/2005 "RAEE" assimilates the 2002/95/EC and the 2002/96/EC Directives of the European Parliament and of the Council of 27 January 2003, and Directive 2003/108/EC on the restriction of the use of certain hazardous substances in Electrical and Electronic Equipment - Apparecchiature Elettriche ed Elettroniche (AEE).

What are the provisions of this Decree?

Starting from 1 September 2007, the measures on the separate collection and disposal of RAEE - Waste Electrical and Electronic Equipment. .

What does RAEE stand for?

RAEE is the acronym for Rifiuti di Apparecchiature Elettriche ed Elettroniche, equivalent to the European acronym WEEE (Waste of Electric and Electronic Equipment).
RAEE means the waste generated from appliances, instruments and devices powered by electricity or batteries, such as:
· Large household appliances
· Small household appliances
· IT and telecommunications equipment
· Consumer equipment
· Lighting equipment
· Electrical and electronic tools (with the exception of large-scale stationary industrial tools)
· Toys, leisure and sports equipment
· Medical devices (with the exception of all implanted and infected products)
· Monitoring and control instruments
· Automatic dispensers

Who is subject to this decree?(Art.3, RAEE Decree)

The Producer

The Producer means anyone who: MANUFACTURES or ASSEMBLES and SELLS in Italy electrical and electronic equipment (Apparecchiature Elettriche ed Elettroniche AEE) under his own brand; RESELLS UNDER HIS OWN BRAND and sells in Italy electrical and electronic equipment produced by other suppliers; INTRODUCES in Italy AEE and manages the marketing, even through long distance sales, such as: • import an AEE from any European or other country and sell it in Italy; • import an AEE already distributed in Italy by others and sell it on the Italian market. For RAEE legislation, even the "distributor - producer" (eg. BESPECO) who resells on the Italian market under its own brand AEE which are manufactured in Italy or directly imported will be considered a "producer".

The Distributor

The Distributor (Reseller) is anyone who, last in the marketing chain, sells electrical and electronic equipment AEE to the end user.

What are the legal fulfilments?

The Distributor (Reseller) when supplying new electric and electronic appliances or equipment destined to domestic use, has, among other things, the obligation to the buyer (end user), to collect free of charge, on a one-to-one basis, the used appliance (of same type). Any appliance deemed non-reusable must be assigned by the distributor to the Centri di Raccolta pubblici (CdR) (Public treatment facilities). The CdR must guarantee accessibility to and functionality of its infrastructure and must permit end users and distributors to assign their RAEE - Waste Electrical and Electronic Equipment free of charge.

At the moment the holding user of a private household AEE (electric and electronic appliance), wishes to dispose of said appliance, it can:

assign it free of charge to a public treatment facility (CdR) in its community (the “ecological platform”);
hand it over to the distributor in exchange for a new appliance with the same functions.

The Producer must ensure that starting from 1 September 2007 all AEE introduced on the Italian market bear the symbol of the “barred rubbish bin” (Fig.1) in a clear and inerasable way in addition to user information in the instructions (Fig.2).
This will ensure that products which must be subject to separate collection will be easily recognizable.

Bespeco’s RAEE Policy:

For the management of Italian RAEE on Italian territory, Bespeco has adhered to the RAEcycle S.C.p.A.

In compliance with the Decree, Bespeco labels its electric and electronic appliance products with the barred rubbish bin symbol (Fig.1) and the related legal fulfilments are noted in the instruction booklet.

User information
The symbol labelled on the appliance indicates that the rubbish is subject to “separate collection”. The user must therefore assign or (have collected) the rubbish to a treatment facility under local administration, or hand it over to the reseller in exchange for an equivalent new product. The separate collection of the rubbish and the successive treatment, recycling and disposal operations promote production of appliances made with recycled materials and reduce negative effects on health and the environment caused by improper treatment of rubbish. Abusive disposal of the product on the part of the user will entail the application of the administrative sanctions in article 50 of the Legislative Decree n. 22/1997.

RAEE03 For items range weight 2 - 5 Kg. Euro 0,40 + Vat per pcs.

RAEE04 For items range weight 5 - 10 Kg. Euro 0,75 + Vat per pcs.

RAEE05 For items range weight 10 - 30 Kg. Euro 1,60 + Vat per pcs.
